Today, Congresswomen Carol Miller and Zoe Lofgren, along with Senators Shelley Moore Capito and Alex Padilla, reintroduced the Preserving Emergency Access in Key Sites Act (PEAKS Act). This legislation aims to ensure that Critical Access Hospitals in mountainous regions receive appropriate compensation for ambulatory services while modifying existing distance requirements.
Rep. Carol Miller emphasized the importance of accessible healthcare for all individuals, particularly those residing in rural areas like West Virginia. “Everyone, regardless of where they live, should have access to quality and affordable health care,” she stated. She highlighted the challenges faced by residents in these regions and described the PEAKS Act as life-saving legislation that will positively impact rural communities nationwide.
Rep. Zoe Lofgren also stressed the necessity of funding for hospitals serving hard-to-reach areas. “All Americans deserve quality access to health services, even if they reside in areas that are difficult to access,” she said. The act is designed to broaden criteria for becoming a Critical Access Hospital and ensure fair compensation for emergency transportation services.
Senator Capito noted the unique transportation challenges posed by West Virginia’s mountainous terrain. “As residents of the Mountain State, we are proud of our beautiful peaks; however, we are also aware of the transportation challenges—especially for ambulances—that exist due to our mountainous topography,” she remarked.
Jim Kaufman, President and CEO of the West Virginia Hospital Association, praised Rep. Miller’s leadership on this issue. He acknowledged her ongoing support for healthcare access in underserved communities: “We commend Congresswoman Miller for her leadership in introducing the PEAKS Act.”
The PEAKS Act proposes reimbursement measures for emergency medical transportation services provided by Critical Access Hospitals located in mountainous areas. Additionally, it seeks to protect these hospitals’ designations despite new hospital constructions within a 15-mile radius.
